Terms of Service

These terms govern your use of Motif. Using the service means you accept them. If you are agreeing on behalf of a company or a client, you confirm you are allowed to.

Motif is a product of Ambitious Machines, Inc., a Delaware corporation with its mailing address at 2810 N Church St, STE 90429, Wilmington, DE 19802, United States. “We” and “us” in these terms mean that company.

The service

Motif makes advertising images from your briefs and your brand kit. An image model paints the scene; Motif then sets the brand on top from the kit you control: the logo, product imagery, colours and type that are locked into every render.

Your account

You sign in with Google or with a link and code sent to your email. You are responsible for what happens under your account and for keeping access to that Google account or email secure. Tell us promptly if you believe someone else has access.

Your content

You own what you upload and what you generate. Motif claims no ownership of your brand kits or of the creative it produces for you. You grant us only the licence needed to run the service: to store your content, to send it to the models that render your images, and to display it back to you.

By uploading, you confirm you have the right to use that material. In particular:

• Logos, product photography and brand assets must be yours or your client's, or licensed to you for this use.
• Fonts must be licensed for the use you are putting them to. Rendering a typeface into an image is not always covered by a desktop or web licence, and that licence is yours to hold.
• Any person appearing in an uploaded image must have consented to their likeness being used this way.

Acceptable use

You may not use Motif to produce:

• Creative that impersonates a real person or a brand you have no authority to represent.
• Material that is unlawful, defamatory, or that infringes someone else's rights.
• Sexual content involving minors, or content promoting violence against people.
• Advertising claims you know to be false, or images intended to be passed off as unedited photographs of real events.

We may suspend an account that breaks these rules. Where it is safe and lawful to do so, we will tell you why first.

Generated images

Image models are probabilistic. Motif sets your brand deterministically, so your logo, palette and type land exactly as configured, but the scene the model paints varies between runs and will not always be what you asked for. Review creative before it goes live. We do not warrant that any output is unique, nor that it will not resemble other work produced by the same models.

Credits and payment

There is no free plan or free trial. A new account can set up its brand kit and look around the studio, and renders need credits from a paid plan or a top-up pack. Renders consume credits. One credit is one standard image, some models cost more, and the cost is shown before you spend. Credits are deducted when a render is submitted, and a render that fails on our side is refunded automatically. Credits have no cash value, are not transferable, and are not refundable once spent on a successful render.

Paid plans add their monthly credits on each paid invoice and renew until cancelled. Change or cancel a plan any time in the billing portal; you keep access to the end of the period you have paid for. Top-up packs are one-time purchases and their credits never expire. Payments are processed by Stripe. Prices are shown before you pay and do not include taxes; where we are required to collect a tax, it is added at checkout. Prices may change with 30 days' notice.

Availability

We work to keep Motif running, but the service is provided as-is. It depends on third-party providers, among them the model providers, and their outages become ours. We do not promise uninterrupted availability.

Liability

To the extent the law allows, Motif is not liable for indirect or consequential loss, including lost profits or lost business, arising from your use of the service. Our total liability in any twelve-month period is limited to what you paid us in that period. Nothing here limits liability that cannot lawfully be limited.

Ending the agreement

You can delete your account at any time in Settings. That deletes your brand kits and ads at once and cancels any subscription, so download what you want to keep first. We may close an account that breaks these terms. If we stop offering the service, we will tell you at least 30 days ahead so you can download your work. Data is deleted as described in the Privacy Policy.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its rules on conflicts of law. Any dispute arising from these terms or from your use of Motif will be decided in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. If you use Motif as a consumer, this does not take away any protection that the law of the place you live gives you and that cannot be set aside by agreement.

Changes

We will email you before any material change to these terms takes effect. Continuing to use Motif after that date means you accept the new version.
